LEGAL

Terms and Conditions

Effective 5 September 2026

These terms explain the IfaLami service, your responsibilities and the main service limits.

1. The agreement

These terms govern use of IfaLami, operated by TECHSMART SOLUTIONS (PTY) LTD, registration number 2023/983817/07, South Africa. By creating an account, buying a plan or using the applicable service after having a reasonable opportunity to read these terms, you agree to them. Mandatory consumer rights continue to apply.

2. What IfaLami does

IfaLami helps you assess preparedness, organise important information, nominate trusted contacts and, where enabled for your plan, store documents or messages and arrange controlled access. The website is an entry point and the ongoing service is primarily supported through WhatsApp. Features and limits shown for your selected plan form part of the agreement.

3. Important limits

Assessment results are based on the answers you select. They are guidance and do not verify that your affairs are complete or legally valid. IfaLami is not an emergency response or continuous welfare-monitoring service and does not provide legal, medical, tax, investment or financial advice.

Storing a will, nomination, instruction or message does not make it legally valid, appoint an executor, change a beneficiary or transfer ownership. Keep legally required originals and independent copies of important records, and obtain professional advice where needed.

4. Your account and content

You must be 18 or older to open an account and have authority to provide the content and instructions you submit. Keep your contact details, trusted contacts and instructions current. Tell us promptly about a lost device, changed number, SIM compromise or suspected unauthorised access.

You retain your rights in your content. You authorise us and our providers to process it only as needed to provide the service, follow lawful instructions and meet legal duties. Do not upload unlawful content, impersonate another person, bypass access controls or try to obtain information without authority.

5. Trusted contacts and release

A nomination does not give a trusted contact unrestricted vault access, ownership of your documents or authority to administer your estate. While you are alive, access or sharing must follow your instructions and required account checks.

Inactivity or a report of death only starts verification. We manually review available evidence and instructions before release. We may require identity, authority and supporting-document checks and may pause a disputed or suspicious request. Incapacity is not treated as death. A court order or binding legal duty may affect the outcome. We do not guarantee a particular release date.

6. Plans and payments

Before purchase, we show the price, billing frequency, included features and limits, and whether the plan renews automatically. Completing an assessment or opening WhatsApp does not authorise payment. Payments are handled through the provider identified at checkout. We may receive a transaction reference and payment status, but you should not send full card details or banking credentials through the chatbot.

7. Cancellation and refunds

You may request cancellation through the service or at hello@ifalami.co.za. We will confirm the effective date and explain remaining access, lawful charges and any refund. Statutory cooling-off, cancellation and refund rights apply where relevant. We do not apply a blanket “no refunds” rule. Any permitted cancellation charge must be reasonable and lawful.

8. Failed payments and suspension

If payment fails, we may notify you and give you an opportunity to resolve it before suspending paid features, subject to applicable law. We may restrict access sooner where reasonably necessary to address fraud, unlawful activity or a serious security risk. Failed payment or suspension never authorises release to trusted contacts. Where lawful and feasible, we will provide a reasonable opportunity to obtain your content before scheduled deletion.

9. Availability and responsibility

Internet, mobile network, messaging and cloud failures may delay access, reminders or delivery. We take reasonable steps to provide the service with the quality required by law, but cannot promise uninterrupted availability or guaranteed message receipt. IfaLami does not insure against loss or guarantee an estate outcome.

Nothing in these terms excludes liability for fraud, gross negligence or liability that may not lawfully be excluded. Nothing removes rights or remedies under consumer or privacy law.

10. Closing your account

Closing your account ends future access according to the closure arrangements and stops future routine sharing, subject to completed delivery and lawful preservation duties. Ask for copies you need before closure. A relative, trusted contact or beneficiary cannot close or take over your account without appropriate authority checks.

11. Changes and complaints

We may update the service or these terms and will notify account holders of material changes through WhatsApp or another available contact channel. Changes do not retrospectively authorise sharing or charges. If fresh agreement is legally required, we will request it.

For support, cancellation or complaints, email hello@ifalami.co.za. South African law governs these terms, subject to mandatory rights and access to competent courts, consumer bodies and the Information Regulator.
